LHDN Stamp Duty
The Lembaga Hasil Dalam Negeri (LHDN is the statutory body responsible for administering Malaysia’s direct tax system and enforcing tax-related legislation, including the Stamp Act 1949 (Act 378). Stamp duty is a mandatory duty imposed on certain commercial, legal, and financial instruments. Proper stamping ensures compliance with the requirements of Act 378 and allows such instruments to be recognised for legal purposes, including their admissibility as evidence in Malaysian courts under Section 52 of the Act.
The document stamping process has undergone significant changes following LHDN’s transition from the previous STAMPS portal to the Stamp Duty Self-Assessment System (SDSAS) through the e-Duti Setem module under MyTax. Under this self-assessment framework, taxpayers are responsible for determining the applicable stamp duty, submitting the required declarations, and making the necessary payments. LHDN retains the authority to conduct audits and reviews of submitted stamp duty assessments within the applicable statutory period.
