In Malaysia, the law is pretty chill when it comes to business. Anyone who already runs or plans to run a business here can apply to register their trademark, even if they're not Malaysian citizens. As long as you have an address in Malaysia, you can apply directly, no need to be Malaysian.

The place to go is the Malaysian Intellectual Property Office (MyIPO). They're in charge of trademarks in Malaysia. So, if you want to register your trademark in Malaysia, be prepared to  

Types of Trademarks

There are three types of trademarks you can register in Malaysia:

  1. Trademark
  2. Certification symbol of trademark (This is for showing specific qualities, precision, materials, manufacturing methods, origin, etc., of products or services.)
  3. Collective mark (This is for groups with legal status to distinguish their members' products or services from others.)

For businesses operating in Malaysia, most folks just go for the regular trademark.

How to Register Trademark and What You Need

You can apply online or offline. If you go offline, you can download the forms from the MyIPO website. The process is the same either way.

Usually, it takes about 12-18 months to register a trademark in Malaysia. Here's what you'll need:

  1. If you're applying as a company, include a copy of your business license or valid registration certificate stamped with the company seal. If you're applying as an individual, include a copy of your personal ID.
  2. Detailed info about the applicant (in both Chinese and English), including name or company name, nature, nationality, detailed address with postcode, and contact details.
  3. A digital copy of your trademark design.
  4. Names and categories of the goods or services which the trademark will apply. 
  5. Statutory Declaration.
  6. For non-English trademarks, provide English translations and interpretations.

The authorization fee must be paid within 2 months after the announcement. In Malaysia, the validity period of trademark registration is 10 years from the date of application. Malaysian trademarks are renewed every 10 years. If the renewal fee is not paid within the deadline, it should be paid within one month after the due date.
