Important Rules & Compliance Standards

  • The building must be located within MBJB's administrative jurisdiction for MBJB-specific record enquiries and building compliance procedures.
  • The applicant must identify whether the request concerns an existing CFO, existing CCC, approved building plan, building record confirmation or new CCC certification.
  • CFO and CCC are not interchangeable application procedures.
  • The CCC system replaced the previous CFO system from 12 April 2007 for applicable projects.
  • A new CCC must be issued by an authorised PSP, not by a consultant, runner or MBJB counter officer.
  • The PSP must satisfy the relevant professional registration and building category requirements.
  • The applicable legal framework includes the Street, Drainage and Building Act 1974 (Act 133) and relevant Uniform Building By-Laws.
  • CCC issuance requires the PSP to verify compliance with approved building plans, applicable technical requirements and safe occupancy conditions.
  • The relevant Form F or Form F1 must be properly completed and issued by the authorised professional.
  • The applicable stage certification documents Forms G1–G21 must be completed in accordance with the project requirements.
  • Technical clearance or supporting documents must be obtained from the relevant agencies where required.
  • MBJB's 2025 CCC deposit checklist requires the applicable Form F/F1, stage certification forms and other specified records.
  • The MBJB checklist states that CCC deposit documentation must be submitted within 14 days from the date of Form F.
  • Approved original building plans and approved amended plans must be uploaded where applicable.
  • As-built drawings may be required where the original approved plans have been amended.
  • Applicants seeking copies of existing CFO/CCC records must use the relevant MBJB record-copy application procedure.
  • MBJB's published copy request form requires a current property assessment tax document.
  • The current title document may also be required depending on the record request.
  • Property and building details must be sufficiently accurate for the relevant records to be identified.
  • Availability of archived records is subject to MBJB's record retention and search procedures.
  • An existing CCC does not automatically authorise subsequent unauthorised building extensions, mezzanines, partitions or changes of use.
  • Building alterations may require separate approved building plans or permits.
  • Building occupancy certification does not replace a business premises licence.
  • A valid business licence does not replace building occupancy and structural compliance obligations.
  • Buildings must maintain appropriate safety, access, fire protection and essential services.
  • The PSP and other certifying professionals remain responsible for the accuracy of their professional certifications.
  • False certification or issuance of CCC without meeting statutory requirements may result in serious legal consequences.
  • Official fees, technical consultant charges and record-copy charges must be confirmed for the specific service.
  • All final certification decisions remain with the authorised PSP and relevant statutory authorities.

Compound & Legal Penalties

  • Delay or inability to retrieve the required CFO, CCC or approved building plan records.
  • Requirement to submit additional property documents, ownership confirmation or authorisation.
  • Delay to business licensing or property administration when required occupancy documents are unavailable.
  • Requirement to appoint an authorised PSP or technical consultant for unresolved building compliance matters.
  • Requirement to obtain separate approval for unauthorised building extensions, partitions or structural alterations.
  • Possible enforcement notices for building works carried out without the required approval.
  • Orders to rectify, alter or remove unauthorised building works where permitted by law.
  • Restrictions on occupation or use of premises where the building is unsafe or does not meet applicable legal requirements.
  • Separate enforcement action for non-compliance with approved building plans, fire safety or structural requirements.
  • Additional costs arising from technical inspections, engineering assessments, amended plans or rectification works.
  • Potential professional disciplinary action against certifying persons for breaches of applicable professional requirements.
  • Under Section 70(27)(b) of the Street, Drainage and Building Act 1974, the MBJB CCC FAQ identifies a maximum fine of RM250,000, imprisonment for a term not exceeding 10 years, or both, for the specified offence involving CCC issuance without the prescribed forms.
  • Other offences under Act 133 or relevant building by-laws may carry different penalties depending on the provision breached.
  • Submission of false documents or misrepresentation of building certification may attract separate legal consequences.
  • A missing archived certificate is not automatically proof that the building was constructed unlawfully.
  • Failure to obtain a copy of an existing certificate is not, by itself, the same as unlawfully issuing a CCC.
